Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and FlippyDisc (“FlippyDisc,” “we,” “us,” or “our”). They govern the FlippyDisc mobile application, flippydisc.app, and our related marketplace, payment, shipping, seller, and support services (together, the “Services”).
Please read these Terms carefully. By accessing the Services, creating an account, listing a disc, or placing an order, you agree to these Terms. If you do not agree, do not use the Services.
1. Scope and related policies
These Terms incorporate any checkout disclosures, listing rules, seller onboarding requirements, in-app instructions, and policies expressly linked from the Services. Our Privacy Policy explains how we handle personal information; it is not part of these Terms unless applicable law says otherwise.
If a supplemental term conflicts with these Terms for a specific feature, the supplemental term controls for that feature. Nothing in these Terms limits a nonwaivable right or remedy you have under applicable law.
2. Eligibility and U.S.-only service
You may create an account, buy, or sell only if you are at least 18 years old, have legal capacity to enter a binding contract, and are located in the United States. Transactions require valid U.S. shipping and ship-from addresses. The Services are not directed to children and may not be used on behalf of someone under 18.
Accounts are available only to natural persons acting for themselves. You may not create or use an account on behalf of another person, a business, an organization, or any other legal entity. You also may not use the Services if we previously suspended or terminated you or if law prohibits your use.
FlippyDisc currently permits selling only by an “Individual Seller”: a natural person who lists and sells discs solely in their personal capacity. You may not list or sell as, on behalf of, or for the benefit of a sole proprietorship, company, partnership, nonprofit, club, dealer, retailer, manufacturer, distributor, professional reseller, or other business or commercial enterprise, whether or not it is formally organized or registered. Using your personal name or account does not make otherwise commercial selling eligible.
If you begin selling as a business or commercial enterprise, you must stop creating listings and contact us. FlippyDisc does not currently convert an individual account into a business seller account. Our Individual Seller policy does not determine how tax, licensing, reporting, consumer-protection, or other law classifies you or your activity, and it does not change any obligation imposed on you by law.
3. Accounts and account security
- Provide accurate, current information and keep it updated.
- Maintain only one account unless we approve otherwise.
- Choose a username that does not impersonate another person, infringe rights, mislead users, or contain prohibited content.
- Keep your device, email account, authentication links, codes, sessions, and seller payout credentials secure.
- Notify us promptly if you suspect unauthorized access or activity.
You are responsible for activity through your account to the extent permitted by law. You may browse some marketplace content without an account, but buying, selling, saving addresses, reviewing, reporting, and other account features require authentication. We may require identity, payment, tax, address, or other verification before allowing a transaction or payout.
4. FlippyDisc’s marketplace role
FlippyDisc provides a venue and transaction services that allow users to list, buy, and sell physical disc golf discs. Unless a listing clearly says otherwise, the seller—not FlippyDisc—is the owner and seller of the disc. When a buyer completes a purchase, the buyer and seller enter a contract for the sale of that disc, subject to these Terms.
FlippyDisc may facilitate payment collection, marketplace fees, tax calculation or collection, seller verification, shipping labels, tracking, support-assisted claim review, refunds, and payouts. Acting in those roles does not make FlippyDisc the seller, owner, manufacturer, importer, appraiser, or insurer of a user-listed item. We do not possess or inspect discs before shipment and do not independently verify every listing statement, user identity, review, or item’s authenticity, safety, legality, condition, weight, or flight characteristics.
We may moderate listings, hold funds, investigate transactions, or help resolve an issue, but we are not obligated to monitor every interaction or prevent every loss. Users remain responsible for doing reasonable diligence and complying with law.
5. Seller obligations and listing standards
By creating or publishing a listing, the seller represents and agrees that:
- The seller qualifies as an Individual Seller under Section 2 and is not listing or selling for a business or commercial enterprise.
- The seller personally owns and possesses the disc, has the right to sell it, and is not listing business inventory, consigned inventory, or property belonging to another person or entity. The disc is not stolen, counterfeit, subject to a lien, recalled, or otherwise unlawful to sell.
- The listing is for the authentic physical disc shown—not a stock image, digital item, raffle entry, mystery item, reservation, reproduction, or substitute.
- All material details are accurate and not misleading, including title, brand, disc type when provided, condition, flight numbers when provided, ink, damage, modifications, photographs, and description.
- Photographs are current, show the actual disc, and disclose material wear, damage, markings, or defects. Editing may not conceal condition or misrepresent color.
- The price complies with the limits shown in the app and does not include hidden charges.
- The seller will keep the listing available, promptly archive unavailable items, and will not sell or promise the same disc elsewhere after it is reserved or purchased.
- The seller will ship exactly the purchased disc using the provided label, will not use dropshipping or undisclosed third-party fulfillment, and will follow Section 9.
- The seller will respond honestly and promptly to verification, fulfillment, issue, return, chargeback, and support requests.
We may reject, edit for formatting, unpublish, or remove a listing; cancel a related transaction; require more information; or restrict a seller if we reasonably believe a listing violates these Terms or creates legal, payment, safety, fraud, or marketplace-integrity risk. We may require a seller to confirm Individual Seller status and may restrict selling if the seller’s information, listings, transaction patterns, or other activity reasonably indicates business or commercial selling. Removal does not waive any obligation arising from an earlier sale.
6. Purchases, pricing, fees, and taxes
Orders
An item placed in a bag is not reserved. Checkout may temporarily reserve a listing while payment is completed. An order is accepted only after payment succeeds and we confirm the order. We may decline or cancel an order for suspected fraud, payment or pricing error, seller or item ineligibility, address or label failure, legal requirements, or a Terms violation. If we cancel a paid order, we will issue any refund owed to the original payment method.
Amounts charged
Before payment, checkout shows the disc price, a buyer-paid marketplace fee, shipping, estimated applicable tax, and the total. The current marketplace fee is 10% of the item price, rounded as shown at checkout. Fees and price limits may change prospectively; the amounts displayed when you authorize a purchase control that transaction. Unless required by law or an approved refund, marketplace and shipping fees are nonrefundable after they have been earned or incurred.
FlippyDisc or its provider may calculate, collect, report, and remit taxes where we determine we have an obligation. Buyers and sellers remain responsible for taxes, registrations, records, and filings the law places on them. Tax calculations may depend on buyer and seller addresses and item details. You authorize us to correct a tax calculation, refund, or charge where permitted by law and reasonably necessary to address an error.
7. Payments, seller verification, payouts, and chargebacks
Buyer payments
Payments are processed by Stripe and its financial partners. By submitting a payment method, you represent that you are authorized to use it and authorize the total shown at checkout, together with any later amount you separately approve. Your bank or wallet provider may impose its own terms or fees. We do not promise that any payment method will always be available.
Seller onboarding and payouts
To sell, you must complete the verification and payout steps we and Stripe require, provide complete and accurate legal, tax, identity, and bank information, and keep it updated. You must onboard as an individual, and the information you provide must identify and correspond to you in your personal capacity. Business or entity seller onboarding is not supported, and you may not submit another person’s or a business’s information to qualify or receive payouts. Stripe’s connected-account and financial-service terms may also apply. We may prevent listing, hold proceeds, or disable payouts until requirements are satisfied.
You must cooperate with any additional verification, recordkeeping, or disclosure requirements that apply because of your sales activity, even if you remain eligible as an Individual Seller under these Terms. We may impose selling limits or restrict selling or payouts where reasonably necessary to comply with law or payment-provider requirements.
The seller appoints FlippyDisc and its payment providers as limited payment-collection agents for marketplace transactions and authorizes us to collect buyer funds, create reserves or holds, issue refunds, reverse or offset transfers, and recover amounts the seller owes under these Terms. A buyer’s payment obligation to a seller is satisfied when FlippyDisc or its provider successfully receives the funds, subject to reversal, refund, dispute, or chargeback.
Seller proceeds become eligible for transfer only after carrier-confirmed delivery and expiration of the 48-hour buyer-protection support window, and may take additional time to reach a bank. We may delay, hold, offset, reverse, or withhold proceeds where reasonably needed for an open issue, return, refund, dispute, chargeback, suspected fraud, negative balance, verification requirement, legal process, sanctions screening, or Terms violation. Payout timing shown in the app is an estimate, not a guarantee.
Sellers pay a payment processing fee equal to 5% of the disc price plus $0.25, rounded to the nearest cent as shown in the app. This contribution helps cover connected-account routing, payout-volume, and monthly active-seller costs charged by our payment provider. It is spread across sales rather than charged as a separate $2 upfront account fee. The disc price, payment processing fee, and resulting seller proceeds locked for an order control that transaction; future fee changes apply only prospectively. Standard payouts to a seller's bank do not incur an additional FlippyDisc fee.
Sellers are responsible for negative balances and amounts arising from their listings or transactions, including approved refunds, chargebacks, reversals, shipping adjustments caused by inaccurate packaging information, fines, and costs caused by fraud or a Terms violation. To the extent permitted by law, you authorize us to offset those amounts against current or future proceeds or request repayment.
Payment disputes
Contact FlippyDisc Support through the order's Contact Us link before initiating a payment dispute so we have an opportunity to investigate. Nothing in these Terms waives a right to dispute a charge that cannot lawfully be waived. Filing a knowingly false, duplicative, or abusive dispute violates these Terms.
8. Addresses and shipping quotes
Buyers and sellers must provide a complete, accurate, deliverable U.S. address and phone number where requested. Address suggestions and verification assist with formatting but do not guarantee deliverability. You are responsible for reviewing the final address before purchase or publication. Additional costs or losses caused by an incorrect address you supplied may be charged to you or deducted from amounts otherwise owed, to the extent permitted by law.
Shipping rates, delivery windows, and arrival dates are estimates from Shippo, USPS, or another carrier. Rates can expire before checkout. Carrier delays, weather, holidays, service interruptions, and address problems may change delivery timing.
9. Seller shipping performance
After a paid order, the seller must:
- Package the exact purchased disc securely in a box or protective mailer that complies with carrier rules and the dimensions and weight submitted or assumed for the quote.
- Use only the FlippyDisc-provided outbound label or QR code for that order, without alteration, duplication, or use on another package.
- Tender the package to the designated carrier promptly and within any ship-by period shown in the app or communicated for the order.
- Retain any carrier acceptance receipt or other shipping evidence until the order is complete.
- Not include hazardous, unlawful, promotional, or unrelated materials.
Carrier tracking controls marketplace shipment status and advances automatically after the carrier scans the package, unless we determine other reliable evidence should apply. We may cancel and refund an order, charge or offset additional carrier costs, restrict an account, or take another reasonable action if the seller fails to ship, uses an inaccurate package specification, misuses a label, or violates carrier rules.
10. Buyer protection, issues, returns, and refunds
48-hour support claim window
The buyer must inspect the disc promptly after carrier-confirmed delivery. To seek a remedy under FlippyDisc’s buyer-protection process, the buyer must contact FlippyDisc Support through the order's Contact Us link within 48 hours after the carrier records delivery. This support request starts the claim. Support will reply to the email address verified on the buyer's account with next steps. The buyer must provide a truthful description and send any reasonably requested photographs, packaging, tracking, communications, or other evidence according to those email instructions.
Eligible issue reasons are:
- the package was not received despite the tracking status;
- the disc arrived materially damaged beyond what the listing disclosed;
- the disc is materially not as described or is not the pictured item;
- the disc appears counterfeit; or
- another material fulfillment problem we determine is covered.
What is not covered
Unless required by law, the program does not cover buyer’s remorse, changed preferences, expected flight performance, ordinary disclosed wear, minor color differences caused by screens or lighting, issues clearly disclosed in the listing, damage caused after delivery, an incorrect address supplied by the buyer, or a claim submitted to support after the deadline.
Investigation and remedy
Claims are reviewed manually through support email. FlippyDisc may request information from both parties and the carrier; place seller proceeds on hold; deny an unsupported claim; offer a full or partial refund; require return of the disc; send return instructions or a return label by email; or take another reasonable action. If a return is required, the buyer must preserve the disc and packaging, follow the emailed instructions, use any label support provides, ship within the stated period, and return the item in the condition received. A buyer who does not complete a required return may lose eligibility for a refund.
Approved refunds are sent to the original payment method. Bank processing times vary. Unless law requires otherwise, FlippyDisc’s determination under this voluntary marketplace program is final. The program is not insurance or a product warranty and does not replace nonwaivable rights a buyer may have against a seller or under law.
11. Prohibited items and conduct
Prohibited items
FlippyDisc currently permits listings only for authentic physical disc golf discs. You may not list, buy, sell, ship, request, promote, or link to:
- counterfeit, replica, stolen, recalled, unsafe, embargoed, sanctioned, or illegally obtained items;
- weapons, drugs, controlled substances, alcohol, tobacco, hazardous materials, biological materials, pornography, exploitative content, or other regulated or unlawful goods;
- items that infringe copyright, trademark, patent, publicity, privacy, or other rights;
- digital goods, gift cards, financial products, services, raffles, sweepstakes, mystery items, preorders, or items other than the actual disc pictured;
- modified or damaged discs whose condition or safety is materially concealed; or
- anything that cannot lawfully be mailed using the provided carrier service.
Prohibited conduct
You may not:
- mislead, defraud, impersonate, harass, threaten, discriminate, exploit, dox, or invade another person’s privacy;
- circumvent fees or safety measures, move a FlippyDisc-initiated transaction off-platform, manipulate prices, abuse promotions, or evade account restrictions;
- create fake transactions, reviews, reports, tracking events, payment disputes, or seller verification information;
- pressure a user to change or remove an honest review or condition a remedy on suppressing criticism;
- upload malware, probe or bypass security, interfere with operation, scrape at scale, reverse engineer except where law permits, or use bots without written permission;
- collect or use another user’s information for an unrelated purpose, marketing, spam, or conduct outside the transaction;
- use another person’s payment, bank, tax, identity, or address information without authorization; or
- encourage, assist, or attempt any prohibited activity.
If you see a prohibited listing, review, or user, use the in-app reporting or blocking tools or email support@flippydisc.app. For an immediate danger, contact local emergency services.
12. User content, reviews, reports, and moderation
Your content
You retain ownership of photographs, listing text, profile material, reviews, issue evidence, reports, and other content you submit (“User Content”). You grant FlippyDisc a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, adapt for formatting and accessibility, display, distribute, and otherwise use User Content only as reasonably needed to operate, secure, improve, support, and promote the Services and related listings. This license lasts while the content is available through the Services and afterward only as needed for backups, transaction records, legal compliance, enforcement, or content already used in materials that cannot reasonably be recalled.
You represent that you own or have permission to submit the User Content and that our permitted use will not violate law or another person’s rights. Do not include sensitive personal information in public content. You may report an intellectual property or privacy concern using the contact in Section 23.
Reviews
Reviews must reflect the honest, first-hand experience of an eligible buyer, address the relevant transaction or seller, and disclose any material connection or incentive. Reviews may not be fake, copied, extortionate, irrelevant, retaliatory, harassing, discriminatory, or contain private information. We do not remove a review merely because it is negative. We may filter, delay, limit, hide, or remove content that violates these Terms, and may preserve it for investigation or legal purposes.
Reports and blocking
Reports must be made in good faith. The blocking feature can reduce interactions or visibility but cannot prevent every incidental appearance, completed-order record, or legally required communication. We may review reported content and account history, request more information, warn users, remove content, limit features, suspend or terminate accounts, or refer matters to providers or authorities. We do not guarantee a particular outcome or disclose confidential enforcement details.
13. FlippyDisc intellectual property and feedback
The Services, excluding User Content, are owned by FlippyDisc and its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable license to use the Services for their intended marketplace purpose. No other right is granted.
If you send an idea or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or compensation. Do not submit confidential information as feedback.
Rights complaints
To report content you believe infringes intellectual property, email support@flippydisc.app with your contact information, identification of the protected work or right, the exact listing or content, a good-faith explanation, and a statement that the information is accurate and you are the rights holder or authorized to act. We may forward the complaint to the user and may remove content or restrict repeat infringers.
14. Privacy and electronic communications
Our Privacy Policy explains our information practices. You agree that we may send electronic communications needed for authentication, orders, shipping, seller verification, payouts, security, support, policy changes, and legal notices. Transactional and account communications are part of the Services and generally cannot be opted out of while the related account or transaction remains active. You are responsible for keeping your email address current.
15. Third-party services
The Services depend on third parties such as Stripe, Supabase, Shippo, USPS, Google, Apple, Resend, and Vercel. Their services, terms, privacy notices, availability, and decisions may also affect you. We are not responsible for an independent third party’s acts, content, policies, or service interruption, but this sentence does not excuse FlippyDisc from obligations that applicable law places on us.
16. Suspension, termination, and account deletion
You may stop using the Services at any time and may request account deletion using the in-app controls described on our Account Deletion page. The request is queued for manual administrator review and signs you out; it does not automatically delete account data. Account deletion does not cancel completed transactions, eliminate payment or repayment obligations, stop an active dispute, or require deletion of records we lawfully retain.
We may warn, restrict, suspend, or terminate access; remove content; cancel listings or orders; hold payouts; or take other proportionate action if we reasonably believe you violated these Terms, created fraud, safety, legal, payment, or reputational risk, failed verification, harmed another user, or exposed the Services to liability. We may act immediately where risk requires and may decline to provide advance notice when law, safety, fraud prevention, or an investigation warrants it.
Sections that by their nature should survive will survive, including payment and repayment obligations, content licenses for retained records, intellectual property, disclaimers, liability limits, indemnity, disputes, and general terms.
17. Service and Terms changes
We may add, modify, suspend, or discontinue features, providers, eligibility, limits, or pricing. We will not retroactively change a completed order’s agreed price. We may update these Terms by posting the revised version and changing the date above. If a change is material, we will provide additional notice when required. Continued use after the effective date of revised Terms constitutes acceptance; if you do not agree, stop using the Services and close your account after resolving open obligations.
18. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” FlippyDisc disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, and warranties arising from course of dealing or usage of trade.
We do not warrant that the Services will be uninterrupted, error-free, secure, or accurate; that a user will complete a transaction; or that a listed disc is authentic, safe, legal, accurately described, or suitable for a particular use. Shipping, tax, delivery, value, rating, and payout estimates are not guarantees.
A seller may provide separate promises about a disc, for which the seller is solely responsible. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you. These disclaimers do not limit nonwaivable consumer rights.
19. Limitation of liability
To the maximum extent permitted by law, FlippyDisc and its owners, affiliates, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, goodwill, or opportunities; or the cost of substitute services, arising from or related to the Services or these Terms, even if advised that such damages were possible.
To the maximum extent permitted by law, the aggregate liability of those parties for all claims arising from or related to the Services or these Terms will not exceed the greater of (a) $100 or (b) the marketplace fees you paid directly to FlippyDisc in the 12 months before the event giving rise to the claim.
The cap does not reduce a buyer refund or seller payout that FlippyDisc has expressly approved under these Terms, and it does not apply to liability that cannot lawfully be limited. Each limitation is an essential basis of the agreement.
20. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless FlippyDisc and its owners, affiliates, officers, employees, contractors, and agents from third-party claims, damages, judgments, losses, liabilities, penalties, and reasonable legal fees arising from your User Content, listing, sale, purchase, shipment, tax obligation, misuse of another person’s information, violation of these Terms or law, or infringement of another person’s rights. We will provide reasonable notice and may control the defense; you may not settle a claim in a way that admits fault by or imposes obligations on an indemnified party without written consent. This section does not require a consumer to indemnify us for our own unlawful conduct.
21. Disputes and governing law
Informal resolution first
Before filing a lawsuit about these Terms or the Services, send a written notice to support@flippydisc.app that describes your name and account email, the facts, the relief requested, and relevant order information. The parties will try in good faith for 30 days to resolve the dispute. This requirement does not prevent either party from seeking urgent injunctive relief, filing an eligible small-claims action, meeting a legal deadline, or reporting a matter to a government agency.
Law and courts
These Terms are governed by the laws of the State of Colorado and applicable federal law, without regard to conflict-of-law rules. Except for an eligible small-claims action or where applicable consumer law requires another forum, the state and federal courts located in Denver County, Colorado will have exclusive jurisdiction, and each party consents to personal jurisdiction there.
22. General terms
These Terms and incorporated supplemental terms are the entire agreement about the Services and replace prior understandings on that subject. If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the rest will remain effective. A waiver must be in writing and is not a continuing waiver.
You may not assign these Terms without our written consent. We may assign them in connection with a merger, financing, reorganization, sale of assets, or by operation of law. The parties are independent contractors. These Terms do not create employment, partnership, franchise, fiduciary, or agency relationships, except for the limited payment-collection appointment expressly stated in Section 7. Section titles are for convenience. “Including” means “including without limitation.” Electronic notices and records satisfy written requirements to the extent permitted by law.
